"Berlin's Rigaer94: Optimistic Future for the "Kadterschmiede""
In a recent court hearing, the district court discussed the admissibility of an eviction lawsuit against the "Kadterschmiede" at Rigaer Straße 94 in Berlin. The hearing, which took place on Wednesday, has brought new developments in the long-standing dispute.
Judge Sebastian Pörschke, presiding over the case, emphasized the importance of implementing crucial decisions, regardless of the location of the place of foundation. He suggested that if the owners can provide all necessary evidence and the lawsuit for eviction against the "Kadterschmiede" is allowed, eviction may proceed.
However, Judge Pörschke has criticized the lack of evidence provided for the validity of the power of attorney, a crucial aspect in previous proceedings. He has expressed serious doubts about the validity of the power of attorney filled out by Lisa Close, the presumed managing director of Lafone Investments Limited, the ownership company facing issues with the validity of their lawyers' power of attorney.
The lawyers of Rigaer 94 claim that the management in the UK only has a straw man function, and that Lafone Investment Limited is a letterbox company to protect the actual owner, who is acting from Berlin. Another point of contention in court is whether the administrative seat of Lafone Investments Limited is in the UK or in Germany.
Lawyer Markus Bernau of the ownership company expressed concern about the discussion regarding the administrative seat of Lafone Investments Limited. He perceives this discussion as an attempt to undermine the owner's right to his property.
Last week, the Regional Court indicated that the process capability of Lafone Investment Limited would not be recognized, and the lawsuits would be dismissed as inadmissible. However, Judge Pörschke has announced that he may invite the managing director personally to a further hearing if the lawsuit is not dismissed as inadmissible.
Negotiations between both sides on Wednesday seem unlikely to result in an agreement. Judge Pörschke, however, advocates for both sides to agree on a long-term usage arrangement. He believes that this would be in the best interest of all parties involved.
The partially occupied house at Rigaer Straße 94 in Berlin is currently under appeal proceedings for the eviction of apartments. A decision on this matter is expected in October. In previous cases, out-of-court settlements were reached, with leaseholders withdrawing. The property company would have to initiate new eviction lawsuits against the current residents.
Daniela Rohrlack, lawyer for Rigaer, tried to calm Bernau by comparing Germany's strict laws regarding company administrative seats to the most liberal ones without a general speed limit. Bernau, however, finds Germany's laws regarding company administrative seats restrictive.
The suspected management of Lafone Investments Limited, active in the Rigaer Straße 94 case, includes Leonid Medved, who is officially registered as the majority owner since April 25, 2025, and Lisa Close, the English managing director involved in several court hearings related to the eviction process.
The admissibility of an eviction lawsuit against the Kadterschmiede had already been discussed by the district court and rejected in 2022, a decision that was confirmed by the Berlin Regional Court. More eviction lawsuits against the residents of Rigaer Straße 94 were discussed on Wednesday.
