Pension Boost with Extra Payments? Federal Social Court Decides on Voluntary Contributions

BASF Discusses Compulsory and Optional Donations - Compulsory pension scheme with optional additional contributions?

Hey there!

Ever wondered if beefing up your pension savings through voluntary contributions could impact your basic pension? Well, the Federal Social Court (BSG) in Kassel is about to shed some light on this matter come Thursday (14:15).

The pensioner at the center of this dispute hails from sweet Baden-Württemberg. The German Pension Insurance chose to snub his request for a basic pension top-up because he clocked in only 19.17 years (230 months) of compulsory contributions instead of the required 33 years (396 months). His voluntary 'side hustle' pension contributions over 312 months did not make the cut for eligibility.

No Equality Violation, Says Previous Courts

Correct, according to previous courts' rulings – including the Social Court Mannheim and the State Social Court of Baden-Württemberg. You see, with the current regulations, voluntary periods don't count towards the years needed for the basic pension. And there's no violation of the equal opportunity principle here! The unequal treatment between compulsory and voluntary contributions is justified because folks who are in it by mandate generally plunge more money, time, and effort into the statutory pension insurance pot compared to those who voluntarily join.

But the plaintiff ain't having it. He claims he's contributed to the pension insurance for years with his voluntary contributions and should enjoy a decent retirement just like those who have the luxury of being forced to contribute.

Almost 1.3 Million Recipients

Here's the skinny on the basic pension. It's an additional pension boost for folks who've been working for a long time yet earning below the average. Our German Pension Insurance reports that over 1.2 million pensions nationwide received the basic pension supplement in the tail-end of 2023, earning an average of 92 euros each, representing roughly 4.9 percent of all pensions. Data for 2024 ain't out yet.
